E-Scooters

Electric kick-scooters, commonly known as e-scooters, are not toys. If used improperly, they can be dangerous to yourself and others.

There are regulations in place under the Highway Traffic Act (HTA) that must be followed.

Under the HTA, Ontario Regulation 389/19: Pilot Project – Electric Kick-Scooters, municipalities within Halton region must opt-in by passing a local by-law to allow e-scooters on their roads. The provincial pilot project is to evaluate the use and operation of e-scooters, and according to Section 3 of the Regulation:

No person shall operate an electric kick-scooter on a highway, sidewalk, trail, path or walkway or in a public park or exhibition ground unless:

  1. such operation is permitted by and in accordance with this Regulation; and
  2. where the highway, sidewalk, trail, path, walkway, public park, or exhibition ground is under the jurisdiction of a municipality, such operation is permitted by and in accordance with a municipal by-law.

Currently, e-scooters are only permitted to be operated in the City of Burlington as part of the Centennial Trail E-Scooter Pilot. They are not allowed to be operated anywhere else in the City of Burlington.

The use of electric kick scooters is prohibited in the Town of Oakville, the Town of Milton, and the Town of Halton Hills, unless operated entirely on private property.

Where permitted, the following safety guidelines must be followed when riding an e-scooter:

  • Be 16 years of age or older;
  • Wear a Canadian Standards Association (CSA) approved motorcycle or bicycle helmet, if 16 or 17 years-old – although helmets are strongly recommended for all riders;
  • Stand at all times;
  • Yield to pedestrians and cyclists;
  • Travel at a maximum of 24 km/h - it’s not lawful or safe for e-scooters to travel faster than that.
  • No passengers, no cargo, and no baskets; and  
  • It is illegal to tow anything – including another person, vehicle, or device.

  • Two wheels (maximum 17 inches) and brakes
  • A bell or horn
  • A white or amber light on the front and a red light on the rear of the e-scooter or worn by the operator on their person
  • An electric motor not exceeding 500 watts
  • Maximum capable speed of 24 km/hr
  • Maximum weight of 45 kgs
  • No pedals or seats (or any surface that could be used as a seat) are permitted
